Article 1 (Application)
These Terms of Use (hereinafter the “Terms”) set forth the conditions for the use of the information and services (hereinafter the “Services”) provided on this website (hereinafter the “Site”) operated by 23 Century Regen Specialist Centre Sdn Bhd, located in Malaysia (hereinafter the “Company”).
By accessing or using the Services, users (hereinafter “Users”) are deemed to have agreed to these Terms.
If you do not agree, please refrain from using the Site.
Article 2 (Prohibited Acts)
When using the Services, Users must not engage in the following acts:
- Acts that violate applicable laws or public order and morals
- Acts that infringe, or may infringe, upon the legitimate rights of other Users or third parties
- Acts that interfere with the operation of the Services, or that involve unauthorized access or attacks on systems contained in the Services
- Acts of using information obtained through the Site beyond personal use, or reproducing, reprinting, or altering it without permission
- Acts that cause disadvantage, damage, or discomfort to the Company or other Users
- Acts of impersonating other Users or providing false information
- Engaging in advertising or business activities without authorization
- Other acts that the Company reasonably deems inappropriate
If the Company determines, with reasonable grounds, that a User has engaged in, or is likely to engage in, any of the prohibited acts above, the Company may, without prior notice, suspend the use of the Services or take appropriate legal action.
Article 3 (Intellectual Property Rights)
All intellectual property rights related to the content provided on the Site, including text, images, and logos, belong to the Company or the rightful rights holders.
Except where permitted by applicable law, reproduction, reprinting, or alteration without permission is prohibited.
When quoting within the lawful scope, the proper source must be clearly indicated.
Article 4 (Handling of Personal Information)
The Company will appropriately handle Users’ personal information in accordance with the Privacy Policy and all applicable data protection laws, including but not limited to the GDPR, CCPA, and PDPA.
By using the Services, Users are deemed to have agreed to the Privacy Policy and the processing of their personal data as required by applicable laws.
Article 5 (Disclaimer of Warranties and Limitation of Liability)
To the maximum extent permitted by applicable law, the Company makes no warranties of any kind regarding the Services.
The Company does not warrant that the Services will meet the User’s requirements, that the content will not infringe the rights of third parties, or that the Services will be continuously available.
To the extent permitted by applicable law, the Company shall be liable only for direct and actual damages that are ordinarily foreseeable and are caused solely by the Company’s negligence.
This limitation does not apply to damages caused by the Company’s willful misconduct or gross negligence.
Article 6 (Changes and Suspension of Services)
The Company may change, suspend, or alter the scale of the Services without prior notice to Users, if reasonably necessary.
The Company shall not be liable for any damages incurred by Users as a result thereof, to the extent permitted by applicable law.
Article 7 (Changes to the Terms of Use)
The Company may amend these Terms when deemed necessary and lawful, without prior notice.
The revised Terms shall become effective upon posting on the Site.
If the User uses the Services after such changes, the User shall be deemed to have agreed to the revised Terms.
Article 8 (Compensation for Damages)
If a User violates these Terms or causes damage to the Company or a third party in connection with the use of the Services, the User shall, at their own expense, compensate for all damages, whether direct or indirect, to the extent permitted by applicable law.
Article 9 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Malaysia, unless otherwise required by applicable consumer protection laws in the User’s country of residence.
In the event of any dispute relating to the Services or these Terms, the courts of Malaysia shall have exclusive jurisdiction as the court of first instance, unless applicable laws grant Users the right to bring claims in their local jurisdiction.
For cross-border disputes, the parties may also agree to resolve matters through international arbitration, such as at the Singapore International Arbitration Centre (SIAC).
Article 10 (Severability)
If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
